How to Use Each Section

Section 1 β€” Parking

Spell out how many spaces each unit gets. List every vehicle type you want to prohibit. Set a towing timeline so owners know what to expect. Section 2 β€” Noise and Quiet Hours

Pick start and end times for quiet hours. Most communities use 10 p.m. to 7 a.m. on weekdays. Weekend hours can be slightly different. Set a separate window for construction noise so contractors know when they can run power tools.

Section 3 β€” Exterior Modifications

This section protects the look of the neighborhood. Check every type of change that needs Architectural Review Committee (ARC) approval. Give the ARC a response deadline so owners are not left waiting. Include a deadline for reversing unapproved work.

Section 4 β€” Pets

Set a pet count, a weight limit, and a leash rule. Require waste cleanup and decide if you need breed restrictions. Keep in mind that service animals and emotional support animals are protected under federal law. Your rules cannot override the Fair Housing Act. Decide if rentals are allowed and set a minimum lease term. Short-term rentals are a common flashpoint, so state your policy clearly. Section 6 β€” Common Area Use

Cover pool hours, guest limits, clubhouse reservations, and fitness center access. Ban glass at the pool if your insurance requires it. Make residents responsible for their guests.

Section 7 β€” Landscaping and Yard Maintenance

Set a mowing schedule and a weed-removal deadline. Limit when holiday decorations can go up and when they must come down. If your community has an ARC, require approval for any tree trimming that affects shared views.

Section 8 β€” Fines and Enforcement

A clear fine schedule is the backbone of fair enforcement. Start with a written warning, then escalate to fixed fines and daily penalties for continuing violations. Always give owners a cure period and the right to request a hearing. Document every step in writing.

Consistent enforcement matters more than strict fines. If the board enforces a rule against one owner but ignores the same violation from another, the association risks a selective-enforcement lawsuit.

Tips for Adopting Your Rules

  1. Cite your authority. The header of the template has a line for CC&R and bylaw sections. Fill it in so owners can verify the board has the power to adopt each rule.
  2. Get legal review. Have your HOA attorney review the final draft. State laws vary, and some rules that seem reasonable may conflict with fair housing statutes or landlord-tenant law.
  3. Distribute before enforcing. Mail or email the adopted rules to every owner. Post them on the community website or portal. You cannot fine someone for breaking a rule they never received.
  4. Review annually. Add a rules review to your annual meeting agenda. Even if nothing changes, document the review in your meeting minutes.
